Agreement to Terms

Welcome to SoGood Tattoo Studio. These Terms and Conditions ("Terms") govern your access to and use of our website, products, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

Please read these Terms carefully before using our Services. If you do not agree to these Terms, you may not access or use our Services.

Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). For major failures with the service, you are entitled to cancel your service contract with us and to a refund, or to compensation for the drop in value of your services. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the ACL or any other applicable law that cannot be excluded, restricted, or modified by agreement.

Eligibility

By using our Services, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into binding contracts
• You will comply with all applicable Australian laws and regulations
• All information you provide is accurate and complete
• You will maintain the security of your account credentials

Account Registration

Purchases and Payments

Product Information

We make every effort to display accurate product descriptions, images, and pricing. However, we do not warrant that product descriptions, images, pricing, or other content is accurate, complete, reliable, current, or error-free. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time.

Pricing and GST

All prices are listed in Australian Dollars (AUD) and include GST (Goods and Services Tax) where applicable. We reserve the right to modify prices at any time, however price changes will not affect orders already placed and confirmed.

Payment Terms

By placing an order, you agree to:

• Provide valid payment information
• Pay all charges incurred by you or on your behalf at the prices in effect when such charges are incurred
• Pay applicable taxes and shipping fees
• Authorize us to charge your payment method for the total amount of your order

Payment processing is handled securely through Square. We do not store your complete credit card information. All transactions are processed in accordance with Australian payment card industry standards.

Order Acceptance

Your receipt of an order confirmation does not signify our acceptance of your order. We reserve the right to accept or decline your order for any reason, including product availability, errors in pricing or product information, or suspected fraud or unauthorized transactions. If we decline your order after payment has been processed, we will provide a full refund.

Shipping and Delivery

We ship to addresses within Australia. Shipping times are estimates only and not guaranteed. We will make reasonable efforts to deliver products within the estimated timeframe. We are not responsible for delays caused by shipping carriers, customs, extreme weather, industrial action, or other circumstances beyond our reasonable control.

Title and risk of loss pass to you upon delivery. If products are damaged during shipping, please contact us within 48 hours of delivery.

Returns, Refunds and Consumer Guarantees

Your Consumer Rights

Under the Australian Consumer Law, you have the following consumer guarantees:

• Products must be of acceptable quality
• Products must be fit for any purpose you specify to us
• Products must match their description
• Products must match any sample or demonstration model

If a product has a major problem, you can choose to reject it and receive a refund or replacement. If the problem is minor, we will repair or replace the product within a reasonable time.

Change of Mind Returns

In addition to your consumer guarantee rights, we offer a 30-day change of mind return policy. If you are not satisfied with your purchase, you may return eligible items within 30 days of delivery for a refund or exchange.

To be eligible for a change of mind return:

• Items must be unused and in original condition with all tags attached
• Items must be returned in original packaging
• Custom or personalized items are not eligible for change of mind returns
• You must provide proof of purchase
• Return shipping costs are the responsibility of the customer for change of mind returns

For faulty or incorrectly supplied items, we will cover the cost of return shipping.

Refunds will be processed to the original payment method within 10 business days after we receive and inspect the returned item.

Intellectual Property Rights

All content on our website, including text, graphics, logos, images, audio clips, digital downloads, data compilations, and software, is the property of SoGood Tattoo Studio or its content suppliers and is protected by Australian and international copyright, trademark, and other intellectual property laws.

You may not:

• Reproduce, distribute, modify, or create derivative works from our content without prior written permission
• Use our trademarks, service marks, or trade names without authorization
• Frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information
• Use any meta tags or other "hidden text" utilizing our name or trademarks
• Remove or alter any copyright, trademark, or other proprietary notices

Tattoo designs and artwork featured on our site are original works or used with permission. Unauthorized reproduction is strictly prohibited.

User-Generated Content

If you submit reviews, comments, photos, or other content to our website, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content worldwide in any media.

You represent and warrant that:

• You own or control all rights to the content you submit
• The content is accurate and not misleading
• Use of the content will not violate these Terms or infringe any third-party rights
• The content does not contain viruses, malware, or harmful code

Prohibited Uses

You agree not to use our Services to:

• Violate any applicable Australian laws or regulations
• Infringe upon the rights of others
• Transmit harmful, offensive, or objectionable content
• Engage in fraudulent, deceptive, or manipulative practices
• Interfere with or disrupt our Services or servers
• Attempt to gain unauthorized access to our systems
• Use automated systems (bots, scrapers) without permission
• Impersonate any person or entity
• Collect user information without consent
• Engage in any activity that could harm our reputation or business

Limitation of Liability

To the extent permitted by law (including the Australian Consumer Law), SoGood Tattoo Studio's total liability to you for any loss or damage arising from or in connection with these Terms or our Services is limited to:

• In the case of goods, the replacement of the goods or the supply of equivalent goods, the repair of such goods, the payment of the cost of replacing the goods or of acquiring equivalent goods, or the payment of the cost of having the goods repaired; or
• In the case of services, the supplying of the services again or the payment of the cost of having the services supplied again

To the extent permitted by law, we will not be liable for:

• Any indirect, incidental, special, or consequential loss or damage
• Loss of profits, revenue, or business opportunity
• Loss of data or goodwill
• Any loss or damage arising from circumstances beyond our reasonable control
